The data used in this research are secondary data obtained from literature studies. The secondary data consist of primary, secondary, and tertiary legal materials. The data analysis in this study employs a qualitative analysis method.The study finds that the rehabilitation of Children in Conflict with the Law in cases of sexual violence has not fully met the principle of the best interests of the child due to the absence of regulations that accommodate specific rehabilitation measures for children involved in such cases. The failure to fulfill this principle is not the fault of the implementing institutions but rather the result of a lack of regulatory frameworks that provide for specialized rehabilitation for children in cases of sexual violence.To ensure that rehabilitation for Children in Conflict with the Law in cases of sexual violence aligns with the principle of the best interests of the child in the future and to minimize the risk of recidivism, assessments must be conducted by professional teams who consider the child’s specific circumstances. Selain itu, artikel ini juga bertujuan untuk mengetahui perlindungan hukum berlandaskan konstitusi. Selama ini konsep kemanfaatan hukum sering diabaikan keberadaannya. Padahal kemanfaatan hukum memiliki peran yang sangat penting dalam suatu sistem hukum. Secara khusus, perlindungan hukum juga bagian dari kemanfaatan hukum itu sendiri. Begitupun dengan kepastian hukum dan keadilan yang selama ini menjadi tolak ukur negara hukum. Diperlukan pemahaman yang lebih luas agar kemanfaatan hukum dapat dipahami oleh setiap subjek hukum pada suatu negara.</p> Diya Ul Akmal Copyright (c) 2025 Jurnal Esensi Hukum https://creativecommons.org/licenses/by-sa/4.0 2025-08-02 2025-08-02 7 1 18 27 10.35586/jsh.v7i1.417 Urgensi Pengaturan Sanksi Pidana Terhadap Pelanggaran Nama Orang, Foto, dan Badan Hukum Terkenal Dalam Rezim Hukum Merek Di Indonesia https://journal.upnvj.ac.id/index.php/esensihukum/article/view/430 <p><em>Law Number 20 of 2016 concerning Trademarks and Geographical Indications provides protection against the use of famous persons' names, photos, and legal entity names in trademark applications submitted to the Directorate General of Intellectual Property. Article 21 paragraph (2) letter a stipulates that a trademark application will be rejected if such elements are used without written consent from the rightful party. However, this provision only results in an administrative sanction rejection of the application without any accompanying criminal sanctions for violations. This normative gap reveals a significant weakness in the legal protection system for intellectual property in Indonesia. This study aims to analyze this legal void and provide recommendations for a more comprehensive legal framework, including the possibility of imposing criminal sanctions. The method used is normative juridical, involving analysis of legal statutes, legal literature, and comparative studies. The findings indicate that criminal sanctions are necessary to ensure deterrence and provide effective legal protection for owners of famous names and legal entities from acts that exploit or damage their reputation<strong>.</strong></em></p> Moh.
